Why do we need contracts and legal agreements as a portrait photographer?

As a professional photographer, we must always have a contract/legal agreement signed and dated by all parties, the photographer and the client. This protects the photographer’s business and the client who is paying, during the portrait session. By having all the photo contact clearly outlined on a signed and dated binding legal document, there can be no misunderstandings about what the cost and service include.

This also covers model release legal forms and photographing minors with the parent/guardian consent.

I use a professional legal contract signing agreement with Cognito Forms; there is no charge, always free for the client, with an option to take payments through Cognito Forms.

ALL SIGNED CONTRACTS ARE A LEGAL AGREEMENT WITH THE PHOTOGRAPHER AND CLIENT WHO SIGNS AND IS A LEGAL AGREEMENT IN US COURT OF LAW.

HOW DO I GET THE CONTRACT/LEGAL AGREEMENT?

Once you contact us regarding hiring us for your portrait session, we will talk over the phone and talk about appointment dates, and you can schedule on our website to book a date for the portrait session. We will require a deposit and signing legal contract and agreement, and after payment will be sent to your email address. All Documents Need to be signed before the portrait session. We will send a legal document by email from “Cognito Forms“.

4. Liability and Risk Management

  • Agreements include clauses for unforeseen circumstances (e.g., equipment failure, illness, weather issues).
  • They limit your liability and set expectations for rescheduling or refunds.

5. Model Release and Usage

  • If you plan to use client images for marketing or portfolio purposes, a signed release is legally required.
  • This protects you from privacy claims.

Legal Photography Contracts Forms

As a photographer with any type of business, we must have legal documents that are related to our business practices.

All documents will be using the Lightfolio Templates on their website via my email address.

The legal forms I will require you to sign and date before the portrait session will be sent by email as a signed PDF document.

  • Minor Model Release Document (Only if you have kids under 18 years old in Oregon)

These are important documents that need to be signed and dated before any photography session starts. Once you have paid for your portrait session I will email the documents, please allow 2-3 weeks before the session, it is important to be pro-active in these documents returning asap.

Client grants Photographer permission to use images for portfolio, marketing, and promotional purposes (including social media and website).
